NEW YORK. A US federal judge ruled on Monday that the Trump administration illegally fired former federal prosecutor Maurene Comey, the daughter of former FBI director and prominent Trump critic James Comey.
US District Judge Jesse Furman found the administration had exceeded its executive authority by dismissing an inferior officer without cause, rejecting the Government’s position that the president may make such firings regardless of the protections Congress has put in place. Accepting that argument, he wrote, would “unsettle the very equilibrium established by this nation’s constitutional system”. He said the administration had invented a new and expansive theory of executive power and used it to remove other employees with long-standing job protections.
Comey had been an assistant US attorney in Manhattan since 2015, prosecuting Jeffrey Epstein, Ghislaine Maxwell and Sean Combs. She was fired on July 16, 2025. Her lawsuit argued the dismissal violated federal laws barring the firing of civil servants for political reasons, and her lawyers contended she was removed because of the president’s hostility toward her father, who led the FBI from 2013 to 2017 before Trump dismissed him.
Furman granted Comey back pay from her firing through December and ruled she is entitled to retroactive reinstatement for that period. The Justice Department said it disagrees with the decision and will appeal in due course.
